OCCUPATIONAL SAFETY AND HEALTH Management System

The OSHMS consists of the development of a logical and step-by-step process based on continuous improvement. It includes policy, organization, planning, implementation, evaluation, auditing, and improvement actions aimed at anticipating, identifying, assessing, and controlling risks that may affect occupational safety and health.

IMPLEMENTATION OF THE OSHMS

The OSHMS must be led and implemented by the employer or contractor, with the participation of workers and/or contractors, ensuring through such system the implementation of Occupational Safety and Health measures, the improvement of workers’ behavior, working conditions and work environment, as well as the effective control of workplace hazards and risks.

HEALTH PREVENTION AND Promotion

Within the framework of the OSHMS, the employer or contractor must address the prevention of occupational accidents and diseases, as well as the protection and promotion of the health of workers and/or contractors, through the implementation, maintenance, and continuous improvement of a management system based on the PDCA cycle: Plan, Do, Check, and Act.

MINIMUM STANDARDS IN OCCUPATIONAL SAFETY AND Health

The Minimum OSH Standards correspond to the set of mandatory regulations, requirements, and procedures for employers and contractors, through which the basic conditions of administrative capacity, financial sufficiency, and operational capability necessary for the operation, execution, and development of activities within the Occupational Safety and Health Management System are established, verified, and monitored.

Application in Colombia

In Colombia, the Ministry of Labor, within the framework of the quality assurance system for occupational risks, has established the reference regulations on the minimum standards required for the Occupational Safety and Health Management System (OSHMS), based on its purpose, the number of workers, and the risk level under which the company is classified, without prejudice to other applicable regulations.

WHO IS A Contractor?

A contractor is an individual or legal entity, consortium, or temporary partnership with whom the respective contract is entered into. The contractor may be a builder, consultant, supplier, or service provider, among others, and is obligated to fulfill a specific service according to the contract specifications in exchange for compensation.

CONTRACTOR Obligations

  • Conduct occupational medical examinations..

  • Maintain affiliation with the Comprehensive Social Security System (ARL – Occupational Risk Administrator, AFP – Pension Fund Administrator, EPS – Health Promotion Entity), noting that occupational risk coverage begins the day after affiliation.

  • Carry out induction in the OSHMS.

  • Provide and monitor the use of personal protective equipment (PPE) according to the task to be performed, identified hazards, and controls established in the risk assessment.

  • Provide training to personnel according to the task to be performed and the identified hazards and controls established in the risk assessment.

  • Install signage and delimit work areas, as applicable.

  • Have safety data sheets (SDS) available in Spanish for chemical or hazardous products and follow recommendations regarding use, storage, and final disposal, in accordance with environmental regulations, as applicable.

  • Provide vehicles for personnel and/or cargo transportation in compliance with applicable regulations

  • Carry out subcontractor control, as applicable (implement a mechanism for subcontractor oversight, ensuring compliance with existing OSH regulations and legislation).

  • Provide emergency response and reporting in coordination with the supervisory unit and the OSH Office of the Human Talent Management Division.

  • Report and investigate accidents together with the supervisory unit and the OSH Office of the Human Talent Management Division.
